On November 6, 2013, the U.S. Environmental Protection Agency amended the Civil Monetary Penalty Inflation Adjustment Rule, revising certain statutory civil monetary penalties to reflect inflation, as required by the Debt Collection Improvement Act of 1996. 78 Fed. Reg. 66643 (Nov. 6, 2013). The rule, set forth in 40 CFR § 19.4, applies to statutory civil monetary penalties under the laws administered by EPA. The new penalty amounts, which became effective December 6, 2013, are mostly unchanged from prior levels, and where EPA has made changes, the increases are modest.
